1. OBJECT, SCOPE AND DEFINITIONS

These general conditions govern the sale, including registration, ordering and access to “BACCUS” products made available by DCD Unipessoal, Lda. Sociedade por Quotas, headquartered at Avenida Associação Comercial e Industrial de Gondomar, 330, of the União de Freguesias de Valbom e São Cosme, municipality of Gondomar, district of Porto, with zip code 4510-688, with registered capital of € 60,000.00, registered at the Commercial Registry Office of Porto under unique registration number 6927/980812, with website www.baccus.pt and apply to all contracts for the purchase and sale of “BACCUS” products entered into between DCD Unipessoal, Lda. and any user who places orders through said website.

2. FOR THE PURPOSES OF THESE GENERAL CONDITIONS

2.1 “BACCUS” – Products sold by DCD- unipessoal, lda, holder of all copyrights or related rights, as well as other rights that may be subject to the protection provided for in the Industrial Property Code, on the website Internet with the above address and supplier of goods available for order on the same site;

2.2 “USER” – Any individual, non-trader, who places an order through the website / website www.baccus.pt;

2.3 These general conditions do not exclude the rights and guarantees of the User contained in the legislation in force for contracts of this nature.

ACCEPTANCE

The execution of contracts for the purchase and sale of Baccus products, presupposes the user’s knowledge and acceptance of the General Conditions.
By accepting the General Conditions, the User confirms having read the General Conditions, having the legal capacity to accept them and to enter into the contract for the purchase and sale of Baccus products.

REGISTER

To place an order, the User will have to register in advance, by filling in the fields in the form on the www.baccus.pt website, something that will only be possible after accepting, understanding and agreeing with the Privacy Policy.

After registering as a customer, the User can access his personal account online, logging in, after entering a personal and non-transferable password, chosen by him, at the time of registration.

From the moment he accesses his personal account online, the User is subject to the present general conditions, as well as to the legal and regulatory rules that govern the respective operation and use.

ORDER

The User can place his online order, at the website www.baccus.pt after proceeding to his prior registration.

To finalize your order, as a registered User, the User must provide the personal data necessary for order processing. For this, the User must fill in all mandatory fields at the time of identification.

When placing his order the User expresses his acceptance, full and complete, of the general conditions of sale, prices and description of the products contemplated in this transaction, which will be the only ones applicable between the two parties.

Any dispute on this last point will be resolved through an exchange of information and with the guarantees mentioned below.

In the absence of availability of the product, Baccus undertakes to inform the User and to reimburse him of the amounts he may have paid within a maximum period of thirty (30) days from the date of knowledge of such unavailability.

All orders will be subject to prior acceptance. Failure to accept your order may be due to one or more of the following reasons:

  • The product you ordered is sold out;
  • Failure to validate the user’s personal data;
  • Difficulty in the readability of the request.

ORDER CANCELLATION REQUEST

If, for any reason, you wish to cancel an order, please note that this will only be possible before the moment of dispatch (Expedition). In this case, please contact Customer Support by calling (+351) 226102617 from 9am to 6pm from Monday to Friday or by email dcd@dcd.pt

TECHNICAL QUESTIONS

We focus all efforts so that the pictures of the product are as faithful as possible to the real product. In some cases the products are displayed in different perspectives and you have the possibility to enlarge the image. Despite the efforts made to achieve this approach to the real product, you should consider the hypothesis of differences in color, appearance or size / shape, which may be due to the monitor or internet browser used by the user. In this way, we advise you to consult the product carefully and in detail and its respective characteristics in order to make sure of them at the time of purchase.

BACCUS online store is optimized to be viewed in several internet browsers: Microsoft Internet Explorer, Microsoft Edge, Mozilla Firefox, Google Chrome, Safari, Opera. It is also optimized for viewing on mobile devices.

BACCUS does not guarantee stock of orders that originated from network interruptions, technical breakdowns or computer errors.

DELIVERIES

Deliveries are now possible for Portugal and almost all other countries of the European Union (Germany, Austria, Belgium, Bulgaria, Corsica, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Netherlands, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Monaco, Poland, United Kingdom, Czech Republic, Romania, Sweden and Ukraine):

Shipping to Portugal is free for purchases over € 50

  • Mainland Portugal ➔ Shipping Cost to pay 5 €
    Delivery Time: 2 to 5 working days after shipment
  • Portugal Islands (Madeira and Azores) ➔ Shipping Cost to pay 7,5 €
    Delivery Time: 3 to 7 working days

PAYMENT

BACCUS has several payment methods:

Credit Card (Visa/Mastercard)

Your order and card details will be sent, duly encrypted, to the bank on the date of your order. After validation and communication from your bank, the order will be processed. In case of refusal, your order will be canceled.

ATM

If you choose this payment method, you will receive an email with the details to make the payment at an ATM or Homebanking service on the internet. Multibanco orders will only be processed after payment confirmation. We suggest that, if you want to reserve stock for your order, make the payment as soon as possible, otherwise we will not allocate stock to your order.

MBWay

With MB WAY you can pay your order quickly and conveniently via your smartphone, simply by having an MB WAY account. MB WAY orders will only be processed after payment confirmation. For more information or to learn how to create an account, see this page: https://www.mbway.pt

PayPal

One of the payment methods most used in online purchases worldwide at first, it is necessary to have a PayPal account. For more information or to create an account, see this page: https://www.paypal.com/pt. If you choose this payment method, the order amount will be charged at the end of the order.

PRICES

Prices must be understood in euros, with taxes and fees included (Whenever it is a country belonging to the European Union). The prices shown take into account the VAT applicable on the invoice date. Any modification of the applicable VAT type will be reflected in the prices of the products. After this date, prices can be modified at any time.

Prices and specifications are subject to change without notice. When processing your order, any and all price errors that may be presented on the website due to technical anomalies will be detected at the time of invoicing. In this situation the customer will be contacted. If the price of the product presented on the website is actually lower, the difference is returned. If the price is higher the customer will be contacted and will be able to accept or cancel the order.

PRODUCT AVAILABILITY

The goods are subject to availability check.

Since there is a time between the moment your order is placed and the order is accepted, we warn that the availability of the product may change.

If, due to unforeseen circumstances, it is necessary to replace a product, you will be contacted with a suggestion of equal or equivalent value to the replaced one, in case you accept the suggestion we will ship the product.

RETURNS / SWAPS

DCD wants its esteemed customers to be satisfied with their purchase, so you have 15 days to request a free exchange or return, complying with the return conditions. You should consult the terms of the return conditions to see if you are covered by the exchange / return without associated costs.

RETURN CONDITIONS

The customer benefits from a period of 15 (fifteen) days, counting from the date of receipt of the articles to try their articles and if one does not fit, or if it does not conform to what you have seen on the website, you can return and receive your refund by bank transfer, or payment method used. To do this, you must go to your “My Account” Panel on the Site, select the option “Exchanges / Returns” (only active during the 15 days after delivery of the order) and submit the return request, justifying the reason. DCD will approve or not the return and, if accepted, will be in charge of scheduling the collection.

The product swap (return with the justification of “Swap/Exchange”) is only possible if the customer wants another size of the same articles that he intends to exchange, or if the articles in question are defective or not in conformity.

All items can be returned, provided they comply with the return conditions.

Rules to comply with when returning:

  • Articles must show no evidence of use, arrangement or damage
  • Items must not have been washed
  • Articles must keep their inner labels in their original state
  • Accessories must be returned in their complete original packaging
  • We do not return or exchange Ceremony items

In the case of returning all items, if it contains an offer, it must also be returned.

In the case of a refund request for an item purchased at a reduced price, due to a special offer, Baccus will refund the amount actually paid by the user.

The return of articles may be made free of charge at our facilities, in a properly closed package, containing the return slip duly filled in.

In the case of Portugal, Shipping Costs will only be offered on a first return / exchange (provided it is approved).

In the case of the rest of the countries, the cost of any shipping return will always be borne by the Customer / User.

NEWSLETTERS BACCUS

BACCUS Newsletter designation is given to e-mailings, promotional offers, and institutional newsletters, information about the company or the User, sent via the User’s e-mail.

You can access and modify your data at any time under “My account” and manage your subscription to the newsletter under “Newsletters”.

PROOF

Computerized records, kept in the computer systems of the company D.C.D – Unipessoal, Lda. in safe conditions they are considered as a proof of communications, orders and payments produced between the parties.

RESERVATION OF RIGHTS

DCD Unipessoal, Lda. reserves the right to change these terms and conditions at any time, without the need to communicate it in advance.

CONSERVATION AND TRANSACTIONS STRORAGE

Orders and invoices will be archived on a reliable and secure medium for the period necessary for their purpose.

APPLICABLE LAW AND COMPETENCE

Portuguese law applies to the sales conditions presented. For the resolution of any dispute there is always the possibility of resorting to an arbitration entity:
